1. Acceptance of Terms

By accessing or using EagleCast.tv (the “Website”, “Platform”, or “Service”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree with any part of the Terms, you must not use our services.

2. Eligibility

You must be at least 18 years old or the legal age of majority in your jurisdiction to use our services.

3. Description of Services

EagleCast.tv provides digital streaming services, including live TV, on-demand content, and related features for entertainment purposes.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and use of the Service.

5. Payment and Billing

EagleCast TV collects one-off payments meaning you won’t be charged automatically. Subject of renewal depends on you, you would have to purchase again when renewing any access plans.

6. Refund Policy

We honor our customers with a full or partial refunds but for the processing fees it is very hard for us to process a refund. We strongly encourage all users to take advantage of our free trial before making a purchase decision and if any issues arise we ask co-operation of the user to resolve it.

7. Modifications to Service and Pricing

We reserve the right to change or discontinue any aspect of the Service at any time, including pricing, features, or content availability. Any price changes will be communicated in advance and will not affect active subscriptions until renewal.

8. Intellectual Property

All content, logos, designs, and trademarks on EagleCast.tv are the property of EagleCast.tv or its licensors and are protected under applicable intellectual property laws. You may not reproduce, distribute, or modify any part of the Service without express written permission.

9. User Content

You retain ownership of any content you upload to the platform but grant EagleCast.tv a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content solely for the purpose of operating and improving the Service.

10. Prohibited Conduct

You agree not to:

• Violate any laws or third-party rights;
• Upload harmful, unlawful, or infringing content;
• Attempt to hack or interfere with our systems;
• Misuse the platform in ways that harm other users or EagleCast.tv.

11. Termination

We may suspend or terminate your account for violations of these Terms or applicable laws. Upon termination, you will lose access to the Service. No refunds will be issued in case of termination due to a violation of these Terms.

12. Limitation of Liability

To the fullest extent permitted by law, EagleCast.tv shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim arising out of or relating to the use of our services shall not exceed the amount you paid in the past 12 months.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the state or federal courts located in Pennsylvania.

14. Affiliate Program Terms

15.1 Participation

Participation in the EagleCast TV Affiliate Program is subject to approval by EagleCast TV. We reserve the right to approve, deny, suspend, or terminate any affiliate account at our sole discretion.

15.2 Affiliate Commissions

Approved affiliates are eligible to earn commissions on qualifying purchases made through their unique referral links.

Unless otherwise specified in writing, the standard commission rate is:

15% of the qualifying purchase amount.

Commission rates may be modified, increased, reduced, or replaced with promotional rates at any time. Any changes will apply prospectively and will not affect commissions already earned.

15.3 Qualifying Referrals

A qualifying referral is a new customer purchase that:

• Is completed successfully;

• Is not refunded, disputed, charged back, or reversed;

• Is properly tracked through the affiliate’s assigned referral link; and

• Complies with these Terms and all applicable laws.

EagleCast TV reserves the right to determine the validity of referrals and commissions.

15.4 Minimum Payout Threshold

Affiliate commissions become eligible for withdrawal once the affiliate account reaches a minimum approved balance of:

USD $15.00

Balances below the minimum threshold will remain in the affiliate account until the threshold is reached.

15.5 Use of Affiliate Earnings

Affiliates may elect to use earned commissions toward the purchase or renewal of EagleCast TV plans, subject to account eligibility and available balance.

EagleCast TV reserves the right to determine how affiliate credits may be applied and whether promotional products or services are eligible for commission-based purchases.

15.6 Payment Schedule

Affiliate payouts may be processed periodically and are subject to internal review, fraud prevention procedures, and verification of qualifying referrals.

EagleCast TV reserves the right to delay, withhold, adjust, or deny commissions where fraud, abuse, suspicious activity, self-referrals, or policy violations are suspected.

15.7 Prohibited Affiliate Activities

Affiliates may not:

• Engage in spam, unsolicited email marketing, or misleading advertising;

• Make false claims regarding EagleCast TV services;

• Impersonate EagleCast TV or represent themselves as employees, agents, or official representatives;

• Use trademark infringement, domain squatting, or misleading website names;

• Generate self-referrals or create accounts for the primary purpose of earning commissions on personal purchases;

• Engage in fraudulent, deceptive, or abusive marketing practices.

Violation of these rules may result in immediate commission forfeiture and termination of the affiliate account.

15.8 Account Suspension and Termination

EagleCast TV reserves the right to suspend or terminate any affiliate account at any time for violations of these Terms, suspected fraud, abuse of the affiliate program, or any activity deemed harmful to EagleCast TV, its customers, or its reputation.

Upon termination, unpaid commissions may be forfeited where fraud, abuse, or material violations are identified.

15.9 No Employment Relationship

Participation in the Affiliate Program does not create any partnership, joint venture, agency, employment, or franchise relationship between EagleCast TV and the affiliate.

Affiliates act as independent marketing partners and are solely responsible for their own taxes, reporting obligations, and legal compliance.

15.10 Program Modifications

EagleCast TV reserves the right to modify, suspend, or discontinue the Affiliate Program, commission rates, payout policies, or related features at any time without prior notice.

Continued participation in the Affiliate Program constitutes acceptance of any updated Affiliate Program Terms.
